These General Conditions of Purchase regulate the use of the website ainhoatoyos.com (hereinafter “the website”) of which Ainhoa Toyos is the owner (See general data in Legal Notice). The use by the customer of the services of the shop presupposes, in any case, adherence to the General Conditions of Purchase in the version published at the time of the purchase order. It is advisable for the customer to read these General Terms and Conditions before proceeding to make a purchase.

Scope of the contract

The present text contains the conditions that regulate the sale of the products (hereinafter, Conditions of purchase) presented on this website by Ainhoa Toyos.

Please read these Terms and Conditions carefully before placing an order, as by placing an order through this website, you agree to be bound by these Terms and Conditions, the Legal Notice, the Privacy Policy and the Cookie Policy. If you do not agree to all of the Terms and Policies, you should not use this website.

Acceptance of the Terms and Conditions of Purchase and Privacy Policy

Before proceeding with your purchase, you must confirm your acceptance of these Terms and Conditions by checking the box “I accept the Terms and Conditions of Purchase and Privacy Policy”. Thus, you declare that you have read and accept without reservation these Terms and Conditions of Purchase and, in particular, that:

  1. You are at least 16 years old and have sufficient legal capacity to enter into contracts.
  2. You may not place any speculative, false or fraudulent orders.
  3. You undertake to provide your e-mail address, postal address and/or other contact details with certainty.
  4. If you do not provide all the necessary information, your order cannot be processed.

Service availability

The items offered on this website will be available throughout the European Union. For orders outside the European Union, please contact us by sending an e-mail to admin@ainhoatoyos.com.

We do not deliver to P.O. Boxes, therefore it is necessary that you provide the complete and exact delivery address.

Validity of the offer and products

The product offer is valid on the ainhoatoyos.com website for as long as the offer is valid, unless a specific period of time is specified, such as in the case of promotions on specific dates.

Ainhoa Toyos reserves the right to withdraw any product or modify the prices of this website at any time without this implying the assumption of any type of responsibility on the part of Ainhoa Toyos.

Responsibility

Ainhoa Toyos limits its liability in the following cases:

  • Ainhoa Toyos applies all the measures concerning to provide a faithful visualization of the product, nevertheless it is not responsible for the minimum differences or inaccuracies that can exist due to lack of resolution, problems of the navigator that is used or others of this nature.
  • Ainhoa Toyos will act with the utmost diligence in order to make the selected product available to the company in charge of transport. However, Ainhoa Toyos will not be liable for damages resulting from a malfunction of the transport, especially for reasons such as strikes, road delays and, in general, any other causes typical of the sector, which result in delays, losses or theft of the selected product.

Reservation of rights

Refusal to process an order

Although every effort will be made to always process all orders, there may be exceptional circumstances that require us to refuse to process an order after the Order Confirmation has been sent, and we reserve the right to do so at any time.

In any case, Ainhoa Toyos will not be responsible for removing any product from this website, removing or modifying any material or content of the website, or for not processing an order once the Order Confirmation has been sent to you.

Verification of personal information

Ainhoa Toyos reserves the right to verify the personal information provided by the customer and to take any measures it deems necessary to verify that the registered person is the holder of the bank account or of the documents or cards used for payment. This verification may take the form of a request for proof of identity and/or address and/or bank documents. If the customer does not respond to such a request within two days of it being made, the order in question will be automatically cancelled, without the possibility of lodging a subsequent claim.

Terms and conditions of purchase

SELECT THE PRODUCT

To buy at ainhoatoyos.com you only have to select the artwork or print you want, select the size (if there are several options) and the number of units (if it is a serialised work). Once you have selected the above, click on the “Add to cart” option and then on the “View cart” option, and then enter your shipping details and access the payment options.

At ainhoatoyos.com you can shop as a Guest or as a Registered User. Registering as a Registered User will give you the opportunity to access the history of your purchases and store your shipping and billing information so that you do not have to re-enter them in future purchases and to receive the informative Newsletter.

CONFIRMATION OF PURCHASE

Acceptance of the purchase must be made by activating the “Finalise purchase” button. Then you must:

  1. Identify yourself as a Registered User (if you have not done so before starting the purchase process), or choose the option to continue as a Guest.
  2. If you have chosen to purchase as a Guest, you will need to provide your personal and shipping details in order to process your order.
  • If you need an invoice, we will ask you for the corresponding fiscal data.
  • Choose the shipping method.
  • Choose the method of payment.
  • Once you have reviewed the order, accept these Terms and Conditions of Purchase and Privacy Policy by ticking the corresponding box, and then click on the “Buy” option.
PAYMENT

All purchases can be paid for using the following payment methods:

  • Cards: Visa, MasterCard and American Express. You will be redirected to the Kutxabank secure environment. We recommend that before making a purchase you check (i) the validity date of your card, and (ii) the limit allowed for purchases.
  • Paypal: through its platform.

Bank processing

Check that you have correctly filled in all the necessary fields. Once you have done so, the data is transmitted in encrypted form using the SSL Protocol. If you choose to pay by credit card, the system will contact the issuing bank to authorise the purchase. Once the bank has confirmed authentication, the card will be charged. If your bank does not confirm authentication, the order will be cancelled. In any case, you will be informed of the result of the operation by e-mail.

By paying by credit card you confirm that it is your property. Payment by credit card will be subject to checks and authorisations by the credit card issuer, so if the credit card issuer does not authorise payment, we will not be able to process the purchase and will not be liable for any delay or non-delivery as a result.

COMPLETION OF THE PURCHASE

Once your purchase has been accepted and payment has been made, you will receive an e-mail with an identification code so that you can check the delivery status of your order.

Please note that all orders are subject to the availability of the products ordered, as well as compliance with the conditions specified in the clause “Acceptance of purchase conditions and privacy policy”.

The price of the products will be the price stipulated at all times in ainhoatoyos.com.

All prices are quoted in EUROS. The prices shown on this website include the corresponding VAT for Peninsula and Balearic Islands, 21% for reproductions of prints and other derivative products and 10% for original works of art and limited series pieces, and exclude the shipping costs specified in “Delivery times and shipping costs”. The purchase of any of the products on this website necessarily entails the obligation to pay a price.

Prices may change at any time, but changes will not affect orders for which you have already sent a shipping confirmation.

Discount codes are not applicable on discounted or promotional products.

Once payment for the artwork has been received, the artwork will be dispatched within a maximum of 3 working days. The customer will be informed via email of the status of their order.

All deliveries are made from Monday to Friday by courier service. Delivery will be made nationally within three (3) to five (5) days and for international destinations from seven (7) to fifteen (15) working days. In exceptional circumstances, this period may be altered due to extraordinary incidents in the transport service or difficulties in the delivery of the goods.

If a first delivery cannot be made, the transport company will contact you to schedule a new delivery.

After 4 to 7 days from the first delivery attempt, and if no satisfactory delivery response has been obtained, the order will be returned to origin. This will result in a charge to the customer of €15 to cover transport and packaging costs due to reverse logistics.

In the case of shipments to provinces or countries where the shipment may be subject to customs clearance, you will be obliged to pay these customs charges upon receipt of your package, and ainhoatoyos.com will not be responsible for them.

Please note that delivery must be possible at the address you indicate during business hours. It is important that you provide a contact telephone number when placing the order in case of any incident during delivery.

Remember that we do not ship to P.O. Boxes, and it is essential that you provide us with the exact and complete delivery address. Only orders placed within the European Union will be accepted.

HOW TO MAKE A RETURN

ORIGINAL WORKS

My aim is that you are completely satisfied with your purchase. Each artwork is published on the website as clearly and transparently as possible and orders are shipped with the utmost care. Therefore, all sales of original works are considered final. If for any reason you are not satisfied with your order, you can email me at: hola@ainhoatoyos.com

REPRODUCTIONS AND PRODUCTS

For reproductions and other products you have a 14 day return guarantee from the day you received your order. To be eligible for a return, the item must be unused, in its original packaging and in the same condition in which you received it.

HOW TO MAKE A RETURN?

To make an exchange or return, please email me at hola@ainhoatoyos.com with the following information:

  • Client’s name
  • Proof of purchase or receipt (payment confirmation e-mail)
  • E-mail address from which the purchase was made
  • Order number
  • Reason for return
  • References of those items to be returned
  • Product for which you want to exchange (if applicable).

WHAT IF THE PRODUCT ARRIVES DAMAGED?

If the return of the products is due to a defect in the item received or the wrong product, please contact me within 24 hours, through the following email address hola@ainhoatoyos.com indicating the following details:

  • Client’s name
  • E-mail address from which the purchase was made
  • Proof of purchase or receipt (payment confirmation e-mail)
  • Order number
  • Reason for return
  • Reference number of the items to be returned
  • Photographs of the damaged product and packaging. (If on receiving the order you see obvious signs of deterioration, knocks, etc…take a photograph of its condition before opening the package before opening the package).

Please note that:

  • Always wait for my reply before sending, I will send you the delivery address and instructions.
  • The return of the order must be made by the customer. You will have to find the transport agency that best suits you and make the return with the data previously provided in the email.
  • The goods must be in the same condition in which they arrived at their destination.
  • Keep the artwork in its original packaging and seal it securelyso that the order does not arrive damaged.
  • Save the order number for tracking purposes.

REFUNDS

Once your return is received and inspected, you will receive an email notifying you that I have received your return.

If the refund is approved I will notify you again and your refund will be processed. The amount will be automatically applied to your credit card or original method of payment within 15 days.

Important

In the event that the return is due to a change of opinion or an error at the time of placing the order, the customer shall bear the costs generated by this return.

In addition, please note the following:

  • Please ensure that the items are in the same condition in which you received them. No refund will be made if the product has been used beyond the mere opening of the product, products that are not in the same condition as delivered or have been damaged in any way.
  • The return must be made in the same way as on delivery: all items to be returned must be included in the same package together with the original packaging and any other accompanying documents (labels, cards, gifts, protective materials, the invoice or delivery note and the duly completed return form).
  • In the event that not all items are enclosed in the package, the corresponding price of the item will be deducted from the amount to be refunded.
  • Returns made carriage forward will not be accepted.
  • Returns made by procedures other than those described here will not be accepted.
  • Refunds will only be given for products that have been returned in accordance with our returns policy.
  • If you are sending a product worth more than €60, you should consider using a trackable shipping service or taking out insurance for the shipment. We do not guarantee that we will receive your return.

By registering as a customer at ainhoatoyos.com, you will be able to view your order history, track your orders and take advantage of exclusive promotions.

HOW TO REGISTER

To register as a Customer, you must click on the option “My account” -> “Register” and fill in the corresponding fields.

To access your user account, click on “My account” -> “Sign in” and enter your e-mail address and password.

In case you forget your password to access your user account, just click on the option “Forgot your password?” and enter your e-mail address, to which you will receive an e-mail to reset your password.

If you choose to register as a customer, I inform you that the personal data you provide will be included only in a file owned by Ainhoa Toyos in order to process your orders and other commercial communications by any means.

In order to send you commercial communications by electronic means (such as the Newsletter) when you register, you must tick the box whereby you expressly authorise us to send such communications. In each commercial communication sent to you, you will be given the option to oppose the sending of such communications, by means of a simple and free procedure. You will also have the option to unsubscribe from our Newsletter in your own account.

In any case, we inform you that you may exercise your rights of access, rectification, cancellation and/or opposition, through your own Client account or by sending an e-mail to admin@ainhoatoyos.com.

MODIFICATION OF ORDER DATA

When placing an order, and before confirming it, you can modify your personal details at any time. Once you have confirmed the order, you can modify the data provided for that order by sending an e-mail to hola@ainhoatoyos.com.

CUSTOMER ACCOUNT DEREGISTRATION

You may at any time exercise your rights of access to your data, rectification, cancellation and/or opposition through your own Client account or by sending an e-mail to hola@ainhoatoyos.com.

Ainhoa Toyos guarantees the privacy of the data you provide us with through the application of the SSL protocol.

The browser indicates graphically that you are in a secure area. Additionally, you can check that you are in a secure area by verifying that the browser address starts with https (instead of http).

Written communications sent to you will be deemed to have been received 24 hours after they have been sent to you by e-mail, or 3 days after the date of posting of any letter.

These Terms and Conditions of Purchase shall be governed in each and every one of its aspects by Spanish law. Without prejudice to any rights you may have as a consumer or user, any dispute arising from matters relating to the Website, you expressly waive any other jurisdiction that may correspond to you, submitting to the exclusive jurisdiction and competence of the Judges and Courts of Bizkaia (Spain).

If any of these conditions or any provision is held to be invalid, illegal or unenforceable to any extent by the competent authority, they shall be severed from the remaining conditions and provisions which shall continue to be valid to the extent permitted by law.
